1. Introduction and Agreement
By using the logistics and delivery services provided by MK Brothers Food Stuff Trading LLC (“The Company”), the Client agrees to be bound by these Terms and Conditions (“Terms”), which govern the collection, transportation, and delivery of perishable goods within the United Arab Emirates (UAE).
1.1 Scope
Our service is exclusively designed for the expedited, temperature-controlled transport of perishable, temperature-sensitive goods. The Client must accurately and truthfully declare the nature of the goods, including any specific requirements.
2. Delivery Service Level Agreement (SLA)
We are committed to speed and guaranteed freshness, operating under the following delivery timeframes:

2.1 Timeframes and Business Days
- Delivery timeframes begin once the goods are successfully collected by The Company.
- Business days exclude Fridays, Saturdays, and official UAE national holidays.
2.2 Exceptions and Delays
Delivery times are estimates and not binding guarantees. The Company is not liable for delays arising from inaccurate address information, unforeseen traffic, governmental restrictions, or Force Majeure events.
3. Handling and Freshness Guarantee
3.1 Specialized Food Handlers
Your perishable goods are safe with our trained, specialized food handlers. Our personnel are extensively trained in food safety protocols, temperature monitoring, and hygienic handling to ensure the integrity of your goods throughout the logistics chain.
3.2 Client Responsibility for Packaging
The Client is solely responsible for the proper packing and preparation of all goods. This is crucial for maintaining the freshness guarantee. Packaging must include appropriate insulation, sufficient cooling agents, and clear labeling. The Company reserves the right to refuse collection of any goods deemed improperly packaged or unsafe.
4. Limitation of Liability and Claims
4.1 Maximum Liability
Unless a separate, written insurance agreement is in place, the maximum compensation for any single shipment will be limited to the lesser of:
- The actual cost to the Client for the goods lost or damaged.
- A maximum of AED [Insert Specific Monetary Limit, e.g., 500] per shipment. (Please insert your specific liability limit.)
4.2 Exclusions of Liability
The Company accepts no liability for:
- Losses or damage resulting directly from insufficient or faulty packaging by the Client.
- Consequential losses (e.g., loss of profit or business interruption).
- Loss or damage due to the inherent vice or defect of the goods themselves.
4.3 Claims Procedure
Any claim for damage or spoilage must be submitted to The Company in writing, supported by photographic evidence, within 24 hours of the scheduled delivery time. Failure to adhere to this timeframe will result in the claim being waived.
5. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Emirate of Fujairah.
6. Changes to Terms
The Company reserves the right to update or modify these Terms at any time without prior notice. The updated Terms will be effective immediately upon posting to the Company’s website.
